Advance Parole Travel Document

Advance Parole is permission for certain foreign nationals, who do not have a valid immigrant visa, to reenter the U.S. after traveling abroad.
Note: If you do not apply for Advance Parole before leaving the U.S., the U.S. Citizenship and Immigration Services (USCIS) considers you to have abandoned your
adjustment of status application, and may not permit you to return to the U.S.

Humanitarian Parole

If you are outside the U.S. and must travel to the U.S. temporarily because of an urgent business or personal situation, you can apply for a humanitarian parole document to be paroled into the U.S. on humanitarian grounds, if you cannot obtain the necessary visa and any required waiver of excludability.
Note: You cannot use Humanitarian Parole to circumvent normal visa issuing procedures, and is not a means to bypass delays in visa issuance. Parole is an extraordinary measure sparingly used to bring an otherwise inadmissible alien into the U.S. for a temporary period of time due to a very compelling emergency.

Who may apply for Advance Parole?

You may apply for advance parole if you currently reside in the U.S. and have a personal or bona fide reason to travel temporarily abroad and have:
An application for adjustment of status pending
Been granted benefits under the Family Unity Program
An asylum application pending
Note: You do not require an advance parole if you have applied for adjustment of status and are maintaining H-1 status (temporary workers in specialty occupations) or L-1 status (intra-company transferees), or are a dependent in H-4 or L-2 status.

Persons ineligible for Advance Parole

You are not eligible for Advance Parole if you are:
In the U.S. without a valid immigration status
A beneficiary of a private bill
Under removal proceedings
Currently in a valid nonimmigrant status
Subject to the two-year foreign residence requirement due to having held J-1 status

Applying for Advance Parole Travel Document

To apply for Advance Parole, you must prove that you have a personal or bona fide reason to travel abroad. Your Advance Parole application must include:
USCIS Form I-131, Application for Advance Parole
Two identical color photographs as per the following specifications:
Taken within 30 days of filing the application
Showing full face (passport style) and with your head bare (unless you are wearing a headdress as required by a religious order of which you are a member)
Has a white background and be no larger than 2 X 2 inches, with the distance from the top of the head to just below the chin about 1 and 1/4 inches
Glossy, un-mounted, un-retouched and printed on thin paper
Note: Lightly print your A# (or your name if you have no A#) on the back of each photo, using a pencil.
Copy of your current passport
Copy of the USCIS Form I-94, Arrival-Departure Document issued to you while you entered the U.S.
Copy of the receipt notice or other evidence that your application for
Green Card is pending with the USCIS
Copies of documents which indicate your current status
