TN Visa (Canadian and Mexican Professionals)

IV.	Duration of Stay


	You may be admitted to the U.S. in TN status up to a maximum initial period of stay for one year. You may receive extensions of stay in one-year increments, with no limit on the total period of stay. However, you must be able to prove that you have a foreign residence and you have no intentions of abandoning it.

Extensions of Stay

Requirements for Canadians and Mexicans wishing to renew their TN status are not the same.

Canadian citizens have two options:

A.	First, your employer must file a Form I-129 at the USCIS Service Center with jurisdiction over the place of employment. This option does not require you to leave the U.S.

B.	Second, you may return to Canada to apply for a new visa at a port of entry with the same documentation that is required for an original application

Mexican citizens must have their employers renew their LCA and file a new Form I-129 with their USCIS Service Center in order to extend their stay.

VI.	Spouses and Children

	Spouses and/or children under the age of 21 who wish to accompany or join you in the U.S. for the duration of your stay can apply for TD visas.
